Acceptable Use Policy

This Acceptable Use Policy (the "Policy") governs the usage of the website and services (the "Services") provided by Dynamix Web Design, LLC (the "Company") to its customers (each, a "Customer") and to any authorized users (each, a "User"). This Policy is incorporated by reference into each contract the Company enters into with a Customer for the use of such Services and into the Terms of Service on the Company's website. By accessing or using the Services, you agree to comply with this Policy and all of its terms and amendments.

1. Scope and Acceptance

1.1 Acceptance of Policy
By accessing or using the Services, you expressly agree to comply with this Acceptable Use Policy, as it may be amended from time to time by the Company without notice.

1.2 Scope
This Policy governs the use of the Services provided by the Company. It applies to all Customers and their authorized Users, including employees, agents, contractors, and any other individuals who access the Services under a Customer's account.

1.3 User Obligations and Account Security
Each Customer is responsible for ensuring that all its Users comply with this Policy. Customers shall implement and maintain appropriate security measures—including safeguarding account credentials—to prevent unauthorized access to the Services.

2. Purpose
The purpose of this Policy is to enhance the quality of the Services and to protect the Company's Customers, as well as the broader Internet community, from illegal, irresponsible, or disruptive activities. This Policy is intended to ensure that the Services are used in a manner that is safe, legal, and respectful of the rights of others. All Users are expected to exercise common sense and good judgment in connection with the Services. Parents and guardians are advised to supervise minors using the Internet and the Services.

3. Prohibited Uses
Users may not use the Services in any manner that violates applicable law or this Policy. Without limiting the generality of the foregoing, the following uses are prohibited:

(a) Spam and Unsolicited Communications

  • Sending mass unsolicited e-mail or other communications to third parties.

(b) Illegal Activities and Intellectual Property Violations

  • Using the Services in connection with any illegal activity.
  • Copying, uploading, ingesting, or otherwise using material (e.g., text, graphics, music, videos, or other copyrightable material) from third parties without proper authorization.
  • Collecting, storing, processing, or transmitting any personal or sensitive data—including regulated data or data subject to privacy laws—in violation of applicable federal, state, or international law.
  • Misappropriating or infringing the patents, copyrights, trademarks, or other intellectual property rights of any third party.
  • Trafficking in illegal drugs, engaging in illegal gambling, distributing obscene materials, or offering any products or services that are prohibited under applicable law.

(c) Tortious or Actionable Conduct

  • Publishing or disseminating information that constitutes slander, libel, or defamation; publicizing personal information or a person's likeness without consent; or otherwise violating the privacy rights of any individual.
  • Threatening bodily harm, harassing, or making abusive statements or messages, or soliciting illegal acts or services.

(d) Disruptive or Abusive Activities

  • Initiating denial-of-service attacks or any other activity that degrades or impairs the operation of the Company's servers or those of other network hosts.
  • Posting messages or software programs that consume excessive CPU time or storage space.
  • Offering mail services, mail forwarding, POP accounts, or autoresponders beyond what is permitted for your own account.
  • Subverting, or assisting others in subverting, the security or integrity of the Company's systems, facilities, or equipment.
  • Gaining unauthorized access to the Company's computer networks or those of any other person.
  • Providing passwords or access codes to persons not authorized to receive such information.
  • Forging, impersonating, or otherwise misrepresenting your identity (including "spoofing") in any manner that deceives or misleads others.
  • Distributing or posting any virus, worm, Trojan horse, or other malicious code intended to disrupt services, destroy data, or damage equipment.
  • Engaging in any activity that might expose the Company to unfavorable regulatory action, increase its liability, or adversely affect its public image, reputation, or goodwill—including sending or distributing sexually explicit, hateful, vulgar, racially, ethnically, or otherwise objectionable materials, as determined solely by the Company.
  • Any activity that interferes with or disrupts the normal use of the Services or the Internet usage of other persons.

4. Reporting, Monitoring, and Enforcement

4.1 Reporting Violations

  • Non-Copyright Violations: Users are encouraged to report any violations of this Policy by emailing abuse@dynamixwebdesign.com. Please include the name of the offending domain (e.g., xyz.com) and a description of the alleged abuse in the subject line.
  • Copyright Infringements: If you believe that your copyrighted work has been used in a manner that constitutes copyright infringement, please submit a notice in compliance with the Digital Millennium Copyright Act (DMCA) to our designated DMCA agent at the address below:

4.2 Monitoring
The Company reserves the right to monitor communications and activities on its network facilities, including the Services, to prevent the introduction of viruses, detect unauthorized or disruptive activities, and enforce this Policy.

4.3 Enforcement and Remedies
The Company may, at its sole discretion, take any or all of the following actions in response to any violation of this Policy:

  1. Issue a warning to the offending Customer.
  2. Suspend the offending Customer's access to the Services.
  3. Terminate the offending Customer's access to the Services.
  4. Impose fees or charges as provided in the applicable service contract.
  5. Remove offending content.
  6. Take other actions as permitted by this Policy, the applicable service contract, or law.

In cases of severe or repeated violations, the Company reserves the right to immediately terminate or suspend access to the Services without prior notice. The Company also reserves the right to cooperate with legal authorities in investigating and prosecuting any claims of illegal activity involving the Services, its Customers, or other Users.

5. Integration with Overall Terms
This Acceptable Use Policy is incorporated into and forms part of the overall Terms of Use for the Services provided by the Company. In the event of any conflict between this Policy and any other provision of the overall Terms of Use, the provisions of the overall Terms of Use shall govern, except where those provisions expressly limit the prohibitions set forth in this Policy.
